У статті визначено поняття «презумпція» та «презумпція законності судового рішення», з’ясовується природа та властивості презумпції законності судового рішення. Зроблено висновок, що презумпцію законності судового рішення можна визначити як рішення суду, що визнається справедливим та законним до тих пір поки не буде відмінене судом вищої інстанції в порядку встановленому законом.
In the article certainly concept «presumption» and «presumption of legality of court decision», nature and properties of presumption of legality of court decision turns out. A problem of presumption of legality of court decision is one of most difficult for scientific research, as touches whole complex of questions, related to understanding of this category, finding out of its nature, essence, value and place, in a right. Problems of application of current legislation and questions which touch functioning of the judicial system acquire the special value in modem terms. One of important aspects of this problematic there is a question of application of presumption of legality of court decision in judicial practice. It is necessary to notice that application of presumption of legality of court decision is in judicial practice, related to the row of problems: at first, a legislation is not given by a decision «presumption o f legality o f court decision»; secondly, at legislative level absent orders in relation to the order of application of this presumption. In addition, legal science and practice require teoretiko-legal to information about this presumption. A large practical value has research of problem of presumption of legality of court decision. It is possible without an overstatement to talk that for a court this presumption carries priority character, because creates pre-conditions for firmness of decisions and, as a result, base for authority of department judicial. The problem of presumption of legality of court decision is mainly taken to the question about that represents a decision exactly, and that concrete authors inlay in this concept. The supporters of this presumption consider that a court as a result of judicial trial comes to establishment of objectivity and legality in a court decision. Presumption of legality of court decision characterizes, formal exteriority of decision. In our view, presumption of legality of court decision matters very much in the field of the legal proceeding and sanctifies the final act of court the presence, requiring from all persons confession of him in quality true, and, consequently, just and legal. A term is presumption appeared from a word «praesumptio» and in translation from Latin means supposition. Supposition is conjecture, previous idea, previous intentions. To our opinion, presumption of legality of court decision which entered into legal force is the position acknowledged at the level of law that a decreet represents objective legality and is obligatory it touches for all subjects, whose rights, duties and legal interests. To refute this position possibly only in exceptional cases and by extraordinary methods, set a law. A conclusion is done, that presumption of legality of court decision can be defined as a decreet, which is acknowledged just and legal until then while will not be anniented the highest court to all right set a law. В статье определено понятие «презумпция» и «презумпция законности судебного решения», выясняется природа и свойства презумпции законности судебного решения. Сделан вывод, что презумпцию законности судебного решения можно определить как решение суда, признается справедливым и законным до тех пор пока не будет отменено судом высшей инстанции в порядке, установленном законом. |
