Дисертація є комплексним науковим дослідженням теоретико практичних засад презумпцій у праві, в ході якого висвітлено історіографію проблеми, природу, структуру, ознаки та функції презумпцій. Запропоновано авторське визначення понять «презумпція у праві» та «функції презумпцій у праві». Удосконалено класифікацію презумпцій залежно від їх закріплення у джерелах права та проаналізовано їх види. З’ясовано особливості закріплення презумпцій у законодавстві України. Обґрунтовано положення про необхідність внесення змін до Конституції України щодо уточнення презумпції знання законів та інших нормативно правових актів. Розглянуто значення презумпцій у процесі застосування права. Окрему увагу приділено висвітленню судової практики з цього питання. Проблеми використання презумпцій у практичній діяльності, пов’язані з тим, що законодавство України не містить визначення поняття «презумпція» та приписів щодо порядку їх застосування. Зроблено висновок про необхідінсть розробки правил, які б регулювали питання застосування презумпцій у практичній діяльності. Вивчено досвід США, Іспанії, Франції та Російської Федерації щодо закріплення презумпцій у законодавстві та їх застосування на практиці.
The dissertation is complex scientific research of theoretical-practical bases of presumptions in the law in which the problems of historiography, the nature, structure, factors and functions of presumptions are investigated. Author's definition of concepts «presumption in the law» and «functions of presumptions in the law» is offered. It is improved classification of presumptions depending on their fastening in sources of the law and it is characterized their kinds. Features of fastening common law presumptions in the legislation of Ukraine are analyzed. The statement about necessity of modification of the Constitution of Ukraine concerning specification of a presumption of knowledge of laws and other regulatory legal acts is argued. The place of presumptions in law enforcement process is defined. Presumptions are used at each stage of application of the law. Experience of the USA, Spain, France and the Russian Federation concerning fastening of presumptions in the legislation and practice is studied. It is established, that enforcement of presumptions in judiciary practice of Ukraine is connected by that the legislation of Ukraine does not make definition of concept «presumption» and there are no instructions concerning an order of their application. The conclusion is drawn on necessity of concept rules, which would regulate problems connected with application of presumptions in practice. |
